EEOC Releases an Updated “Know Your Rights” Poster

As of 10/24/2022, a new version of the “Know Your Rights: Workplace Discrimination is Illegal” poster has been updated and re-released. The Equal Employment Opportunity Commission (EEOC) has released a ‘Know Your Rights’ poster which will replace the previous ‘EEO is Law’ poster. The poster has been created to help advance the EEOC’s mission to help prevent unlawful employment discrimination and remedy discrimination when it occurs in the workplace.

The EEOC enforces laws that require covered employers to post notices and/or posters that describe Federal laws prohibiting job discrimination. These posters typically include a summary of laws regarding job discrimination and explain how employees and applicants can file a charge if they believe they have experienced discrimination in the workplace.

The updated ‘Know Your Rights’ poster now includes updated language and bullet points which helps employees and employers understand their legal rights and responsibilities. The poster also includes information for how to contact the EEOC for assistance.

Changes to the “Know Your Rights” poster include:

  1. Straightforward and easy to understand language and formatting
  2. Harassment in the workplace as a form a prohibited discrimination
  3. Clarification that sex discrimination includes discrimination based on pregnancy and related conditions, sexual orientation, and gender identity
  4. An added QR code for digital access to the ‘how to file a charge’ webpage
  5. Information specific to employers holding federal contracts regarding equal pay discrimination

Employment law posters are to be posted and visible in a workplace where applicants and employees can access, and where notices are typically posted. Employers are also encouraged to post a notice digitally on their website. The EEOC has also stated that remote workplaces which no longer have a physical location can meet the posting requirement by only posting the notice digitally where employees may access the information.
