rendered-1On May 18, the Department of Labor issued a press announcement about the publication of a new OFCCP Directive. The Directive extends the enforcement moratorium related to Affirmative Action obligations of TRICARE providers for two years. The freeze has been in effect for four years, and will now expire on May 7, 2021. The original extension was set to end in May 2019. The extension also applies to Veterans Affairs Health Benefits Program (VAHBP) providers.

The exemption has been in place for several years and only applies to healthcare providers with contracts solely related to TRICARE or VAHBP. It is important for contractors to gain a further understanding of any other existing government contracts they may have in place. As the exemption only applies to contractors that only provide services under TRICARE or VAHBP. If contractors also have other covered government contracts, the exemption does not apply. The extension provides the agency time to solicit feedback from stakeholders, and give OFCCP the opportunity to evaluate legislation that may be enacted to make the exemption more permanent. The agency has signaled the intent to solicit feedback, focused on the extent to which the OFCCP requirements are applicable to TRICARE providers.
