OFCCP Requests Voluntary Reporting of EO 14173 Compliance

Earlier today, OFCCP Director Catherine Eschbach sent an email letter to federal contractors offering the “opportunity to provide information about their efforts to wind down compliance with the EO 11246 regulatory scheme and ensure full compliance with the Nation’s non-discrimination laws.”
The request comes as part of OFCCP’s implementation of EO 14173, which revoked the EO 11246 regulations but allowed contractors to continue to follow those regulations until April 21, 2025.

Contractors who choose to respond to this voluntary request have 90 days to provide OFCCP with information about how they have implemented EO 14173. Submission can be made through OFCCP’s Contractor Portal in a narrative format.

Our team is evaluating this new request by OFCCP and will provide more information in the coming days. We recommend that contractors also take time to fully evaluate the Director’s request before responding.

Berkshire clients will have an opportunity to attend a webinar next week to discuss the ramifications of this letter and our recommendations. If you're not a client but would like guidance, please reach out to us.
