OFCCP Restructure Update

According to an internal email reviewed by Bloomberg Law, OFCCP Director Ashley Romanias announced a restructuring plan for the agency that would

  • establish a “Branch of Field Operations” within the Division of Program Operations for remaining field staff, and

  • consolidate regulatory, legislative, policy, outreach and help desk functions in the Division of Policy and Program Development.

The email also said position descriptions will be updated; however, grades, pay, and duty locations will not be impacted. Director Romanias stated that the new structure is “streamlined” and will “capitalize on the knowledge, skills, and abilities of existing staff.”

ICYMI – After the rescission of Executive Order 11246 in January 2025, the OFCCP ‘s operating status has continued to evolve. Despite proposals by the Administration to transfer the agency’s remaining programs to different agencies, the OFCCP continues to have enforcement authority under Section 503 of the Rehabilitation Act (Section 503) and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). In addition, although President Trump’s proposed Fiscal Year 2026 budget did not allocate any funds to the OFCCP, in January, Congress approved a budget for the agency of a little over $100M through September 30, 2026.

Throughout 2025, many OFCCP employees left the agency or were transferred to positions outside of the OFCCP, leaving a small number of staffers operating out of the National, Southwest and Rocky Mountain regional offices. Earlier this year, the OFCCP continued to move personnel, with OFCCP Northeast Regional Director, Diana Sen announcing on LinkedIn that she was named the OFCCP Deputy Director, which is the highest career-level role at the agency.

Despite the uncertainty, the agency also moved toward aligning with the Administration's goals by:

  • Revising Complaint Forms: Updating complaint forms to focus on Section 503 and VEVRAA and to remove references to EO 11246.

  • Continuing VEVRAA/Section 503 Oversight: Issuing requests to maintain recordkeeping requirements under VEVRAA and resuming investigations of individual complaints under Section 503 and VEVRAA.

In a statement from a DOL spokesperson, the reorganization of the OFCCP “is an essential part of right-sizing OFCCP in order to fulfill its core statutory responsibilities” and that federal nondiscrimination laws will “continue to be fully enforced.”
