State of Minnesota Department of Human Rights Makes Changes to the Workforce Certificate and Equal Pay Certificate

The State of Minnesota’s Department of Human Rights is the entity that issues and enforces Workforce Certificates and Equal Pay Certificates for businesses entering into certain contracts with the State. Effective July 1, 2021, there are some changes to the certifications to be aware of for companies who hold a certificate or plan to pursue a certificate.

  1. The fee required when renewing or applying for a certificate is now $250. For those currently holding an active certificate, this rate will be applicable upon next renewal.
  2. Businesses might be required to obtain a Workforce Certificate if their primary place of business is inside or outside of Minnesota
  3. A penalty for noncompliance with the Minnesota Human Rights Act may be imposed on contractors. This penalty may be as high as $5000 per calendar year/per contract and could also suspend a certificate and impact a contractor’s ability to bid on future projects.
