OFCCP Compensation Directive Guidance

OFCCP recently issued guidance on how contractors should comply with the Executive Order 11246 requirement to evaluate compensation systems for gender-,race, or ethnicity-based disparities. Though this requirement is not new, the Biden administration has focused on how contractors satisfy this regulatory obligation as part of its focus on pay equity.  

Until very recently, most contractors were able to provide a narrative description of any compensation review to demonstrate compliance. But OFCCP’s recent directives make clear that the agency now will seek more information about your compliance with this regulatory requirement if you are audited.
