On President Biden’s first day in office, he signed nine Executive Orders. One of these was Executive Order (EO) 13988: Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation. This EO was signed with the intent to extend dignity and respect to everyone “no matter who they are or whom they love”, protecting the rights of the LGBTQ+ community. This EO requires the head of all federal agencies review existing “regulations, guidance documents, policies, programs, or other agency actions” in the interest of fostering diversity and inclusion efforts.
Section 2 of the EO states that the head of the federal agencies should review all existing guidance that were endorsed or are administered by the agency under Title VII or other law that disallows sex discrimination and identify any agency guidance that are or may be contradictory with this EO. Additionally, agency heads are directed to contemplate any other actions that their respective agency should take to ensure that it is fully executing Executive Order 13988.
Within 100 days, the head of each government agency should build and deliver a plan to carry out actions that align with the EO. Please be sure to check back for update on the implementation of this Order.
