The Case for Objective Performance Management Processes: Pay Equity, Promotions, and Terminations (RIF)

Dr. Thomas Carnahan (Berkshire), Dr. Rick Holt (Resolution Economics), and Guy Brenner (Proskauer Rose) will discuss that outside of workers whose productivity can be easily and objectively measured through quality and quantity of production, the measurement of performance of employees rests, for most employers, on subjective evaluations of competencies, quality, and completion rates.

Performance measures for administrative, professional, and management employees have often shown that it’s less the performance of the employee but the relationship between the rater and ratee that matters. When questioned by employees, compliance agencies, or even plaintiff’s attorneys as to why an individual got a different raise or was promoted over another employee, performance management is the usual go-to defense.

This webinar will discuss the case for more objective performance management processes along-side the pitfalls of subjective approaches including bias, inconsistency, and employee buy-in/morale/retention.

About Dr. Thomas Carnahan

Thomas Carnahan, Ph.D is the Senior Manager of People Insights at Berkshire and is responsible for managing Berkshire’s Compensation and HR Services line of business. Thomas and his team focus on performing market analyses, preliminary analyses of pay, statistical outlier analysis, support for clients during audits or other pending/active litigation, and our proactive pay equity line of business.

With two decades of experience in research methodology, data analysis, and HR process development, Thomas brings to Berkshire advanced-level data capabilities, and an extensive background that will serve to enhance our pay equity solutions and market study work. Thomas holds a Ph.D in Industrial/Organizational Psychology from Capella University.

About Dr. Rick Holt 

Rick Holt is a Partner at Resolution Economics, LLC, an economics, statistics, forensic accounting, and economic damages consulting firm with offices in Los Angeles, Chicago, Washington, D.C., New York, and Charlotte. He has a Ph.D. in Economics from the University of Virginia, as well as a B.S. in Industrial Management from Purdue University. Prior to joining Resolution Economics, Dr. Holt was a Principal at ERS Group, a Manager and Bates White LLP, a Manager at KPMG LLP, and a Research Economist at the U.S. Census Bureau.

Dr. Holt is a labor economist that has been involved in projects over the last 15 years covering all aspects of employment discrimination cases, including: compensation, hiring, promotion, and termination. Dr. Holt has worked with several Fortune 500 companies on projects involving OFCCP investigations, FLSA wage and hour cases, and economic damages (single-plaintiff, multi-plaintiff, and class actions). He has also assisted clients in the context of settlement discussions, trial preparation, and consent decree reporting. Dr. Holt specializes in utilizing large and complex databases and the development and estimation of sophisticated statistical/econometric models.

About Guy Brenner

Guy Brenner is a partner in the Labor & Employment Law Department at Proskauer Rose and leads the Firm’s Washington, D.C. Labor & Employment practice. He is head of the Government Contractor Compliance Group, co-head of the Counseling, Training & Pay Equity Group and a member of the Restrictive Covenants, Trade Secrets & Unfair Competition Group. He has extensive experience representing employers in both single-plaintiff and class action matters, as well as in arbitration proceedings. He also regularly assists federal government contractors with the many special employment-related compliance challenges they face.

Guy represents employers in all aspects of employment and labor litigation and counseling, with an emphasis on non-compete and trade secrets issues, medical and disability leave matters, employee/independent contractor classification issues, and the investigation and litigation of whistleblower claims. He assists employers in negotiating and drafting executive agreements and employee mobility agreements, including non-competition, non-solicit and non-disclosure agreements, and also conducts and supervises internal investigations. He also regularly advises clients on pay equity matters, including privileged pay equity analyses.
