The Uniform Guidelines at a Crossroads: History, Controversy, and the Future of Employee Selection

Date: October 21, 2026 - 2:00pm (ET)

This webinar will provide a timely and practical examination of the Uniform Guidelines on Employee Selection Procedures (UGESP) and their enduring role in employment testing, hiring, promotion, and other talent decisions. Employment attorney Consuela Pinto and industrial-organizational psychologist Brian Marentette will explore the legal and scientific principles that underpin the guidelines and the reasons they have remained a cornerstone of personnel selection practice for more than four decades.

Participants will learn how the Guidelines have been applied by courts, regulatory agencies, employers, and testing professionals to evaluate adverse impact and support the validity of employment decision tools. The webinar will also review recent developments in the regulatory and political landscape, including discussions about the future of the Guidelines and the perspectives being advanced by both government stakeholders and industry groups.

Drawing on both legal and psychometric perspectives, the presenters will discuss potential implications for employers if the federal government were to modify or abolish the Guidelines, and what standards, frameworks, or best practices might emerge in their place.

Attendees will leave with a deeper understanding of the practical, legal, and scientific issues surrounding the Uniform Guidelines and the considerations organizations should be monitoring as the future of employment selection regulation continues to evolve.
