The California Pay Data Reporting Portal is open for the 2024 filing cycle. As in the past filing cycle, private employers of at least 100 employees (with at least one employee in California) must file the Payroll Employee Report, regardless of whether the employer is required to file an EEO-1 report. Private employers who had 100 or more labor contractor employees in the snapshot period (with at least one in California) must also file a Labor Contractor Report. Both reports are due May 14th, 2025.

 

While most of the requirements remain the same from the previous reporting cycle, the California Civil Rights Department (CRD) has allowed the addition of the MENA (Middle Eastern or North African) race code to be used in their reporting for this cycle. In addition to the new race option the CRD is still allowing the use of non-binary as a sex choice in their reporting. The threshold and data reporting requirements are the same as they have been in previous years, which includes the mean/median hourly rates, pay bands, race/ethnicity and sex data, and remote status of employees. The CRD has also taken the time to update their resources on their website to make this process a bit easier for private employers and labor contractors. Those resources can be found here.
