According to the Illinois Equal Pay Act, all private employers with at least 100 Illinois employees and file an EEO-1 report are required to obtain an Equal Pay Registration Certificate (EPRC) by March 23, 2024. Businesses who are subject to this requirement were expected to submit an application to obtain the EPRC between March 24, 2022 and March 23, 2024, and then recertify every 2 years thereafter. The Illinois Department of Labor (IDOL) collected contact information from businesses who were subject to this requirement and assigned each business a date by which they must submit their application. However, the law specifies that “The Department’s failure to assign a business a registration date does not exempt the business form compliance with this section.”

The EPRC requires the employer to provide wage records, a signed equal pay compliance statement and pay a $150 filing fee. If you are unsure if you are subject to this law or have any questions regarding the law, please contact your employment counsel and review the FAQ from IDOL.
