OFCCP’s focus on disability compliance is not slowing down. And Berkshire is monitoring onsite visits from the Section 503 focused reviews. In those reviews and establishment reviews, OFCCP is digging into compliance further for disability. When was the last time your organization surveyed current employees for their disability status? There is a requirement to re-survey every five years, and if you are unable to determine when the last survey was conducted, it’s recommended to schedule that survey now.
When was the last time your organization reviewed the physical and mental qualifications of your jobs? Berkshire is tracking OFCCP requests for these items in audits. If there are physical or mental limitations or requirements for a job, the job requirements should be documented. When was the last time your organization reviewed the applicant process and leave policies? These should not have an adverse impact on an individual with a disability. It is a best practice to schedule these reviews on at least an annual basis.
Is your organization using tests in the screening of job seekers? If so, these tests should be validated by an outside testing expert, to ensure they are job-related. Other requirements include documenting the specific outreach sources/events for IWDs. The effectiveness of these sources should be reviewed and evaluated on an annual basis. The evaluation should include numbers of applicants if possible and provide documentation as to why the source will be used again or discontinued.
